Report Online Infringement Using E-Commerce and Social Media Reporting Tools

Although STOPfakes receives many concerns about counterfeited products and intellectual property (IP) infringement on e-commerce platforms, did you know that many e-commerce businesses have their own resources for reporting counterfeits and IP infringements on their own websites? The following list of over 30 of the world’s most popular e-commerce retailers and online marketplaces contains various links to their associated IP policies, information, resources, and other infringement reporting mechanisms. Consumers may also report counterfeiting and piracy to the U.S. National Intellectual Property Rights Coordination Center (IPR Center) using the “Report IP Theft” form.

However, please keep in mind that IP rights are territorial (registration in one country does not automatically confer rights or enforcement in another country), and thus IP rights holders should ensure they register or establish their IP rights (patents, trademarks, copyrights) in the jurisdiction where the infringement occurs or where they operate. Although trademarks and patents generally require formal registration for strong protection, copyright protection automatically arises upon creation for works from Berne Convention countries (although registration in foreign markets may significantly streamline enforcement). Unregistered trademarks may get limited protection via unfair competition laws if widely recognized or used prior, but this can be challenging to prove. E-commerce platforms typically assess complaints based on local or regional IP registrations and may reject notices relying solely on rights registered in other countries.
